I have land just outside of the bayou sara unit which is unleased. I spoke with an Encana rep and believe at this time they are no longer leasing property and are going to force pool all remaining properties. I have a lease offer from trinity. Anyone have thoughts about what to do under these conditions???

EnCana (and any other energy company that operates, meaning drills wells) wants every square foot under lease in a unit that they can get at terms they consider reasonable.  They don't wish to Force Pool the little guy and not get the benefit of his proportional production.  Force Pooling is often misunderstood by mineral owners.  It's prime purpose is to force parties with development rights (leases) to cooperate to produce the minerals.  That's why Working Interests are charged risk penalties and unleased mineral interests (UMI) are not.  LA mineral codes protect the UMI to a much greater extent than other states.

If you can get lease terms you find acceptable from Trinity, you can enter into a lease with them.  However it is best where possible to be leased to the operator as that usually results in a better royalty percentage.  Keep in mind that all operators must abide by the terms of your lease even it is not their lease.  When your minerals are included in a unit and the unit operator has spud a well is an excellent time to negotiate a lease.

The encana rep implied they were going to force pool having already aquired 75% of the mineral rights in the area. Encana also wasn't interested in much negotiating. The rep implied they are forced contractually to drill X amount of wells but they were refocusing their efforts in MS b/c it was cheaper to drill there. The rep did believe encana would be back to wf. I guess they will come running if the rosemound well and bayou sara well hit.....

The Lake Rosemound Field unit(DeLee property well) is directly above this new unit. They named this new field Bayou Sara Field. This well will be on what locals call Mulberry Hill - Spillman land in part. The 2 units touch each other on their North/South borders. There will be another unit, yet unannounced, due east on the John Willis property.

Though Trinity did offer me a lease, which I  have not taken, I do not know if they represent anyone else.

They have been signing my neighbors and talking w/ me. With a well so close to me by encana i have to believe there are others interested in leasing.

  Mac, respond to my friend request and I will give you my 2 cents worth of advice regarding my contact with Trinity and others and Island Road.

There is no minimum number of acres under lease required to apply for a drilling & production unit with the State of Louisiana.  The EnCana rep doesn't know what he's talking about or he is purposely feeding you disinformation.
