Ben Elmore commented on Keith Mauck (Site Publisher)'s blog post Is Aubrey McClendon's resignation a good thing for the CHK's mineral owners? (poll)
"Since most of their production is tied up in long-term gas contracts they entered with CEMI before CHK sold its midstream business, I don't think royalty owners will see much of a change.  IMO.  The terms in those…"

Ben Elmore replied to adubu's discussion Is there a time limit an operator must drill addtions well in unit?
"No, IMO it is a difficult case to make that, given low gas prices the past 4 years, an RPO would have drilled an additional well or well(s), because of the economics. "

Ben Elmore replied to adubu's discussion Is there a time limit an operator must drill addtions well in unit?
"The problem is your theory is based on the assumption that gas prices are going to rise in the future.  Under the law, that is too speculative, even if Warren Buffet is your expert.  Our appellate courts would never allow it IMO. …"

Educate Yourself About Your Rights! The Draconian Application of Statute of Limitations in Texas

Posted on January 14, 2011 at 9:29am 2 Comments

I wanted to let Texas royalty owners know the importance of educating yourself about what your rights are as mineral owners.  Your rights can be taken away if you are not proactive to protect them.  I've attached an article I co-authored almost two years ago discussing how the Texas Court system has eroded royalty owner rights over the past 12 years via a draconian application of applicable statutes of limitations. (Limitations are known as "prescription periods" in Louisiana, and the need…

Primer on Texas Oil & Gas Law

Posted on December 16, 2010 at 11:16am 8 Comments

I am an oil and gas lawyer in Houston with roots in East Texas.  I was born and raised in Jasper, Texas and have family ties still in the area.  I have been an oil and gas lawyer for ten years.  I started out representing operators, but have since devoted myself to representing landowners and doing my part to educate the masses on their legal rights.  I've started with educating my own family.  We own acreage in East Texas and South Texas, but I was surprised to learn that nobody had a clue…

Ben, my grandfather has mineral rights in Shelby COunty in the 30's, those were passed to my mother and siblings upon his death, and upon my mothers death were passed to us. all our lives my mother always reminded us to never forget those minerals. my Grandfather leased them out, the my mother leased them out, the my siblings and I leased them out, I have paper work to back this up, then when they put a well on the land, we were informed we did not own them. the last time we leased them out was 3 years ago. We do not know what to do, should be taken them to court. Cabot Oil is the one telling us to back off. Betty
